RESOLVED:  That, having carefully considered all the relevant information including:

 

·                    written and oral representations by all the parties;

·                    the Licensing Act 2003 and the steps that are appropriate to promote the licensing objectives;

·                    the Guidance issued under section 182 of the Licensing Act 2003;

·                    Harrow Council’s Licensing Policy;

·                    the Human Rights Act 1998;

 

the Panel agreed to grant the premises licence as follows:

 

·                    Late night refreshment Sunday to Thursday 23.00-01.00 the next day;

 

·                    Fridays & Saturdays 23.00-03.00 the next day;

 

·                    Hours open to the public Sunday to Thursday 06.30-01.15 am the next day;

 

·                    Friday & Saturday 06.30 am to 03.15 am the next day.

 

This is on the basis that the steps to promote the licensing objectives noted in the operating schedule are extrapolated as conditions on to the licence, with the following modifications:

 

·                    the premises will maintain a CCTV system in operation ensuring that there no blind spots;

 

·                    recordings shall be held for a minimum of 31 days and copies made available to the Police and Licensing officers expeditiously on request;

 

·                    on Fridays and Saturdays from 23.00 until the premises closes, there shall be employed at least 1 SIA officer;

 

·                    the upstairs restaurant area shall be closed off and locked to members of the public from 22.00 until opening time the next day.

 

Reasons:  The Panel has considered the evidence put forward by the parties and notes that the premises has operated almost trouble free since December 2010 and that most of the incidents that have occurred in the vicinity have occurred at  times when this premises has an SIA officer present.

 

The Panel is mindful of the potential for crime and disorder and public nuisance issues that may arise but believe that having an SIA officer at the weekends is sufficient and that this together with the conditions on the licence will promote the licensing objectives.
