TAKE NOTICE THAT following a hearing before the Licensing and General Purposes Sub Committee (the “Licensing Panel” or “Panel”) on 11th December 2024

 

HARROW COUNCIL, as the Licensing Authority for the Premises

 

RESOLVED AS FOLLOWS:

 

1.             The Licensing Panel convened on 11th December 2024 to determine an application to vary an existing premises licence for the GOODFELLAS, 278 Station Road, Harrow, HA1 2EA (the “Premises”).

 

2.             The Premises are currently licensed for the sale of alcohol on and off the premises for Sunday to Thursday 10:00 to 22:30, Friday and Saturday 10:00 to 23:00 and are open Monday to Sunday 10:00 to 23:00 (the “Existing Licence”).  A copy of the Existing Licence, which includes licence conditions, is shown in Appendix 1, at pages 11-17 of the Agenda.

 

3.             The Applicant seeks to vary the licence to extend the hours of the sale of alcohol on and off the premises to Sunday to Thursday 10:00 to 01:00 (the following day) and Friday and Saturday 10:00 to 02:00 (the following day). In addition the Applicant is seeking to add Late Night Refreshment (Indoors and Outdoors) for Sunday to Thursday 23:00 to 01:00 (the following day) and Friday and Saturday 23:00 to 02:00 (the following day) with the opening hours matching the proposed sale of alcohol timings (the “Application”). As part of the Application the Applicant cites that the premises are being refurbished to operate as a bistro and restaurant with a capacity of 68.

 

4.             As part of the consultation, the Licensing Authority received a representation from one local resident (“the Objector”) who was concerned about the impact and potential increase of noise and anti-social behaviour from the extended hours. The representation submitted by the Objector is shown at Appendix 5 and on page 37 of the Agenda. The representation therefore reflects concerns with the upholding of the four licencing objectives focussing on the prevention of public nuisance and the prevention of crime and disorder.

 

5.             The Licensing panel carefully considered all the relevant information including:

 

·       Written and oral representations by all the parties

·       The Licensing Act 2003 and the steps that are appropriate to promote the licensing objectives

·       The Statutory Guidance issued under section 182 of the Licensing Act 2003 (“the Statutory Guidance”)

·       London Borough of Harrow Statement of Licensing Policy (“the Council’s Policy”)

·       Human Rights Act 1998

 

6.             The Licensing Panel hearing was held in person and in making its decision, the Licensing Panel carefully considered the Application and all written representations, as set out within the report and the oral representations made at the hearing. The Applicant’s agent, Ms Emin attended the hearing whilst the Object also attended in person.
