TAKE NOTICE THAT following a hearing before the Licensing and General Purposes Sub Committee (the “Licensing Panel” or “Panel”) on 19 September 2024

 

HARROW COUNCIL, as the Licensing Authority for the Premises

 

RESOLVED AS FOLLOWS:

 

1.              The Licensing Panel convened on 19th September 2024 to determine an application to vary an existing premises licence for the Vogue Lounge, 136 High Street, Wealdstone, Harrow, Harrow, HA3 7AL (the “Premises”).

 

2.              The Premises are currently licensed for late night refreshment for Monday to Sunday 23:00 to 03:00 the following day, and are open Monday to Sunday 07:00 to 03:30 the following day (the “Existing Licence”).  A copy of the Existing Licence, which includes licence conditions, is shown in Appendix 1, at pages 17-22 of the Agenda.

 

3.              The Applicant seeks to vary the licence to add the sale of alcohol for consumption on and off the Premises, and to replace the existing premises licence plan with a new plan that extends the licensable area to include the extension to the Premises (the “Application”).  The Application also proposes to add Mr Ali Haydar Gumus to be the DPS for the Premises and includes proposed licensing conditions and the Application is also shown in Appendix 1, at pages 23-38, with page 38 showing the amended Licence Plan.

 

4.              As part of the consultation, the Licensing Authority received representations from the public objecting to the variation. One was sent in by Ms Chandler, which was signed by 13 people including herself.  One of those signatories, Ms Croft, also sent in a further representation.   These objections are shown at Appendix 2 of the Agenda and primarily express concerns regarding the prevention of crime and disorder and the prevention of public nuisance, raising concerns such as the level of music and noise emanating from the Premises, and the risk that existing anti-social behaviour caused by people in the immediate vicinity of the Premises may increase if the sale of alcohol is permitted.  The objections incorrectly refer to the sale of alcohol being sought up until 03:00.

 

5.              The Panel Members also received a Supplemental Agenda, in which the Applicant submitted a document arguing that the Licensing Authority exceeded its authority by extending the statutory consultation period beyond 28/08/2024, and that as a result any representations received after 28/08/2024 should not be considered by the Panel.   Further statements in support of the Application were provided by the Applicant to the Licensing Authority the day before the hearing.

 

6.              The Licensing panel carefully considered all the relevant information including:
