RESOLVED TO TAKE THE FOLLOWING STEPS IN RELATION TO THE PREMISES LICENCE, AS APPROPRIATE TO PROMOTE THE LICENSING OBJECTIVES:

 

RESOLVED TO REFUSE THE APPLICATION TO TRANSFER THE PREMISES LICENCE

 

REASONS:

1.              Theapplication soughtto transferan existingpremises licencefor thePremises known as Delhi Darbar, 1st Floor, Eurotraveller Hotel, 56-60 Northolt Road, Harrow, HA2 0DW (the “Premises”), from London Kadai Limited to Aarti Banqueting Limited.

 

2.              ThePremises issituated inan areaof mixed commercialand residential properties.

 

3.              Thelicensing panel carefully consideredall the relevant information including:

·       Writtenand oral representations

·       TheLicensing Act 2003

·       TheGuidance issued under section 182 of the Licensing Act 2003

·       HarrowCouncil’s LicensingPolicy

·       HumanRights Act 1998

 

4.              During the Licensing Panel hearing the facts giving rise to the application for the transfer of the premises licence were set out by the Licensing Officer and were agreed by the Applicant.

 

5.              The Panel heard from the applicant’s representative that the transfer of the premises licence was required as at the current time the Premises are being run by two parties, whohave hada fallingout. Therehas beena struggleto getthe partiesto communicate, with one and other, which has hampered this application and the submission of evidence. It was confirmed Aarti banqueting dealt with the banqueting side of the business and London Kadai Ltd held the licence. In respect of the objections raised by thepolice itwas assertedthat therewas someconfusion onthe partof thepolice inthat the company had given disclosure of all material required, in particular CCTV, to the metropolitan police and they asserted they had not communicated that with the licencing police.So, they say CCTV had been provided. They said that the applicant ifgranted thetransfer ofthe Premiseslicence would havein placea designatedpremises supervisor and promote the licencing objectives. Regarding the party on the 27April 2024, the applicant stated this incident occurred outside the Premises, when the venue had cleared up and closed.

 

6.              ThePanel heardfrom PCBhandari onbehalf ofthe Police,who arethe objectorto this application.The Panelwas informedthe Policehad madewritten representationsto the Licensing Authority and attended virtually. They stated that they were unaware who was running this business at the current time and multiple emails and calls had been unanswered.
