Appointment of Chairman

To appoint a Chairman for the purposes of this meeting.

Minutes:

RESOLVED:  That Councillor Kairul Kareema Marikar be appointed as Chariman of the Licensing Panel.

Declarations of Interest

To receive declarations of disclosable pecuniary or non pecuniary interests, arising from business to be transacted at this meeting, from:

 

(a)               all Members of the Panel;

(b)               all other Members present.

RESOLVED:  To note that there were no declarations of interests made by Members.

[Note:  Licensing Panel minutes are:-

 

(1)               approved following each meeting by the Members serving on that particular occasion and signed as a correct record by the Chairman for that meeting;

(2)               not submitted to the next panel meeting for approval.

 

Reasons: The Licensing Panel is constituted from a pooled membership. Consequently, a subsequent Panel meeting is likely to comprise a different Chairman and Members who took no part in the previous meeting’s proceedings. The process referred to at (1) above provides appropriate approval scrutiny].

Public Questions , Petitions and Deputations

To receive any questions, petitions or deputations (if any), under the provisions of Committee Procedure Rules 17, 15 and 16 (Part 4B) of the Constitution respectively.

 

Questions will be asked in the order notice of them was received and there be a time limit of 15 minutes.

Procedure to be followed at an oral hearing.

Minutes:

The Chairman asked the Panel Members, officers, the Responsible Authority and other attendees at the meeting to introduce themselves and then outlined the procedure for the conduct of an oral hearing, which was set out in the agenda.

RESOLVED:  That, having carefully considered all the relevant information including:

 

·                    written and oral representations by all the parties;

·                    the Licensing Act 2003 and the steps that are appropriate to promote the licensing objectives;

·                    the Guidance issued under section 182 of the Licensing Act 2003;

·                    Harrow Council’s Licensing Policy;

·                    the Human Rights Act 1998;

 

the Panel agreed that the premises licence be modified by imposing the following additional conditions:

 

1.                  the Designated Premises Supervisor (DPS) shall make sure that there is someone on site at all times who is able to operate the CCTV system and to download images from it;

 

2.                  there will be clear and prominent signage on the premises advising all staff and patrons that smoking is not permitted in any enclosed area of the premises;

 

3.                  the DPS shall ensure that all staff attend training in relation to the Licensing Act 2003 at least twice per annum.   A record of all such training must be kept at the premises and be made available to officers of the Metropolitan Police and the Local Authority upon request;

 

4.                  there shall be a minimum of four door supervisors on site (or more if required by the Police upon a written request) from 21.00 hours until 30 minutes after the time for the premises to close, on Fridays, Saturdays and any Sunday falling within a bank holiday.  This condition shall replace condition three on the existing licence;

 

5.                  and the DPS shall attend a minimum of two Pub Watch meetings, or two meetings of a similar scheme per annum, and shall keep an up to date record of all such attendances on the premises ready for inspection.  This condition shall not apply if there is no such scheme in the Edgware area.

 

Reasons:  The Panel considered that the decision promoted the licensing objectives of the prevention of crime and disorder, the prevention of public nuisance, and public safety.
