Appointment of Chairman

To appoint a Chairman for the purposes of this meeting.

Minutes:

RESOLVED:  That Councillor John Nickolay be appointed as Chairman for this Licensing Panel Hearing.

To receive declarations of personal or prejudicial interests, arising from business to be transacted at this meeting, from:

 

(a)               all Members of the Panel;

(b)               all other Members present in any part of chamber.

RESOLVED:  To note that the following interests were declared:

 

Agenda Item 6 - Application for a new premises licence in respect of 'Pinner Hill Golf Club', South View Road, Pinner, HA5 3YA

 

Councillor John Nickolay declared a personal interest in that he had visited the above premises in a Mayoral capacity.  He would remain in the room whilst the matter was considered and voted upon.

 

Councillor Stephen Wright declared a personal interest in that he had visited the above premises.  He would remain in the room whilst the matter was considered and voted upon.

[Note:  Licensing Panel minutes are:-

 

(1)               approved following each meeting by the Members serving on that particular occasion and signed as a correct record by the Chairman for that meeting;

(2)               not submitted to the next panel meeting for approval.

 

Reasons: The Licensing Panel is constituted from a pooled membership. Consequently, a subsequent Panel meeting is likely to comprise a different Chairman and Members who took no part in the previous meeting’s proceedings. The process referred to at (1) above provides appropriate approval scrutiny].

Procedure to be followed at an oral hearing.

Minutes:

The Chairman asked Panel Members, officers and other attendees at the meeting to introduce themselves and then outlined the procedure for the conduct of an oral hearing, which was set out in the agenda.

RESOLVED:  To grant the premises licence as sought subject to the following timings and conditions:

 

Licensable Activities and Hours Open to Public:

 

·                    Live music, and 

 

·                    Recorded music, performance of dance or anything similar, provision of facilities for making music and dancing, and

 

·                    Sale of alcohol:

 

Sunday to Thursday

11.00 am – 11.00 pm

Friday and Saturday

11.00 am – midnight

 

·                    Late night refreshment:

 

Friday and Saturday

11.00 pm – midnight

 

·                    Hours open to public:

 

Sunday to Thursday

7.15 am – 11.00 pm

Friday and Saturday

7.15 am – midnight

 

Conditions (apart from those which will go in annex 2 of the licence based on the operating schedule):

 

·                    After 11.00 pm amplified music or other entertainment noise from within the premises shall not be audible at any nearby premises.

 

REASONS:

 

The licensing panel carefully considered all the relevant information including:

 

·                    Written and oral representations by all the parties;

·                    The Licensing Act 2003;

·                    The Guidance issued under section 182 of the Licensing Act 2003;

·                    Harrow Council’s Licensing Policy;

·                    The Human Rights Act 1998.

 

The Panel’s decision was based on promoting the licensing objectives and in particular related to the prevention of public nuisance.
