Appointment of Chairman

To appoint a Chairman for the purposes of this meeting.

Minutes:

RESOLVED:  That Councillor Thaya Idaikkadar be appointed Chairman of this Licensing Panel Hearing.

To receive declarations of personal or prejudicial interests, arising from business to be transacted at this meeting, from:

 

(a)               all Members of the Committee, Sub Committee, Panel or Forum;

(b)               all other Members present in any part of the room or chamber.

RESOLVED:  To note that there were no declarations of interests made.

[Note:  Licensing Panel minutes are:-

 

(1)               approved following each meeting by the Members serving on that particular occasion and signed as a correct record by the Chairman for that meeting;

(2)               not submitted to the next panel meeting for approval.

 

Reasons: The Licensing Panel is constituted from a pooled membership. Consequently, a subsequent Panel meeting is likely to comprise a different Chairman and Members who took no part in the previous meeting’s proceedings. The process referred to at (1) above provides appropriate approval scrutiny].

Procedure to be followed at an oral hearing.

Minutes:

The Chairman asked the Panel Members, officers, Responsible Authority and other attendees at the meeting to introduce themselves. He then outlined the procedure for the conduct of an oral hearing, which was set out in the agenda.

RESOLVED:  That, taking into account:

 

·                    The Licensing Act, guidance under Section 182 of the Licensing Act, specifically paragraphs referred to the Panel by the License holders representative

·                    The Licensing objectives

·                    Harrow Council’s Licensing Policy

·                    The Human Rights Act 1998

·                    The principles of natural justice and having considered all representations,

 

the following conditions be added to the premises licence in addition to those presently stated:

 

(1)               An appropriate automatic noise control device must be fitted for all amplified sound providing regulated entertainment.  The device must be set so that the volume of any amplified sound emanating from the premises does not cause a public nuisance.  A compliance certificate must be supplied for the installation of the unit and submitted to the licensing authority for approval.

 

The Premises Supervisor can ensure that any amplified sound is inaudible at the boundary of any properties where the occupiers are likely to be affected by noise.

 

(2)       All external areas will be cleared of patrons by 23:00;

 

(3)       No entry or re-entry to the premises is permitted after 23:00;

 

(4)       The front and rear doors and windows must be kept closed after 21:00 except for emergencies and for access.

 

Reason:  To ensure that any amplified sound from the premises does not cause a public nuisance and the applicant has an effective method to adequately control the level of amplified sound and music in order to prevent public nuisance.  The Panel believed that the decision would promote the licensing objective pertaining to the Prevention of Public Nuisance.
