Decision of the Licensing Sub-Committee

 

17th September 2024

 

Unit 2,Brember Road, South Harrow, Harrow, HA2 8AX  (“the Premises”)

 

This is an application for a standard Temporary Event Notice (“TEN”) made under section 100 of the Licensing Act 2003 in relation to Unit 2, Brember Road, South Harrow, Harrow, HA2 8AX (the “Premises”).

 

The TEN seeks to permit the sale by retail of alcohol (on premises only), the provision of regulated entertainment and the provision of late-night refreshments.  This event is due to take place from 20:00 hours on Friday 27th September 2024 until 02:00 hours on Saturday 28th September 2024.

 

An objection notice was received from the Local Authority’s Environmental Protection Team regarding concerns that allowing the premises to be used in accordance with the TEN would undermine the licensing objective of the prevention of public nuisance following the Applicant’s previous event held on 2nd August 2024.

 

The Objector was not in attendance.

 

The Sub-Committee must consider whether or not the Applicant can positively promote the licensing objectives in the local area.  The options available to the Sub-Committee are to either approve or reject the TEN.  The Sub-Committee are not at liberty to impose conditions on the TEN due to the Premises not having an existing premises licence or club premises certificate.

 

The Licensing Officer presented their report to the Sub-Committee.

 

The Applicant advised the Sub-committee, that she had planned to film and host a dating show followed by an after party.

 

The Sub-Committee queried with the Applicant regarding her last TEN Application and the representation made by the Environmental Health Team as their objection was based on noise nuisance.

 

The Applicant advised that she made checks on two occasions to see if the music was audible outside the Premises.  She advised that the first check was at 9pm where she walked up and down Brember Road and could not hear any music and could not remember the exact time of the second check but still could not hear the music along the road.  The Applicant acknowledged that when approaching the main entrance of the Premise that the music was audible.

 

She further advised that two officers from Licensing Team attended the Premises, and Police attended on two occasions during the evening and did not find any issue.

 

She was not informed by Environmental Health Officers or Licensing Officers that there was an issue with the noise.  If she was informed that she would have taken the appropriate steps to mitigate any noise nuisance.

 

The Sub-Committee asked the Applicant why she was seeking late hours as the area local business close around 12am.  The Applicant advised recording would take a few hours and that the patrons that would attend this event have different working hours, and the time sought would allow them to attend.  The Sub-Committee made further enquiries regarding the nature of the event.  The Applicant advised that it is based on American dating show where a group of people are introduced to each  ...  view the full minutes text for item 35.
