Decision:

The Council is due to enter into a 1954 Landlord and Tenant Act protected statutory renewal of a commercial lease at Unit 7, Monks Way, Preston Brook, Runcorn, Cheshire, WA7 3GH

The terms were negotiated by Gerald Eve’s Manchester office and they have confirmed are the best terms available in the current market.

Alternative options considered/rejected by the officer: The council has no requirement to occupy or redevelop this property, therefore the S26 statutory lease renewal notice was accepted.

Declaration of Interest: None.

Terms of any express authorisation: Under the Constitution, Section 4K ‘Financial Regulations’, sub-section F6, Land and Property Disposals, delegates the decision to enter into statutory leases, where the value (cumulatively) is over £499k, to the Leader. The value of the proposed lease is £246k annual rent for 5 years so is at least £499k in cumulative value. This Delegated Authority report therefore recommends that the Acting Strategic Director, Housing and Regeneration, following consultation with the Portfolio Holder for Business, Employment & Property as well as the Leader agrees the terms to enter into the lease as noted above. The Leader gave his approval to proceed on 14.03.25 and Cllr Stevenson,was consulted on 11.2.25 and approved the same.
